IMPORTANT NOTICE

This is an important legal document that affects your rights.

Please read this document carefully before registering for or participating in any Rob Coad Adventures event, tour, adventure, retreat, experience or activity.

Rob Coad Adventures provides a wide range of experiences, including active adventures, hiking and trekking, paranormal experiences, historical tours, retreats, domestic and international travel, private group experiences and other activities.

The risks associated with each experience may vary.

Nothing in this document is intended to exclude, restrict or modify any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

1. PARTICIPANT ACKNOWLEDGEMENT

By registering for, booking, attending or participating in any Rob Coad Adventures event, tour, adventure, retreat, experience or activity (the Adventure), I confirm that I have read and understood this Participant Waiver, Risk Acknowledgement & Consent.

I acknowledge that this document applies to my participation in the Adventure for which I have registered, including activities, locations, transport, accommodation and experiences forming part of that Adventure.

2. NATURE OF ROB COAD ADVENTURES EXPERIENCES

Depending on the particular Adventure, activities may include, but are not limited to:

  • walking, hiking, trekking and bushwalking

  • running and fitness activities

  • climbing, scrambling and navigating natural terrain

  • outdoor and remote area activities

  • camping and overnight activities

  • visits to historic, heritage and battlefield sites

  • paranormal investigations and exploration

  • activities conducted in darkness or low-light conditions

  • visits to historic, abandoned or potentially hazardous buildings and structures

  • travel by motor vehicle, bus, aircraft, ferry, boat or other transport

  • overnight stays in hotels, hostels, campsites or other accommodation

  • activities organised or provided by independent third-party operators

  • other activities described in the information provided for the particular Adventure.

I understand that not every Adventure involves all of these activities and that the activities and risks applicable to my particular Adventure will be described in the relevant Adventure information.

3. ACKNOWLEDGEMENT OF RISK

I acknowledge that participation in an Adventure involves inherent and other risks.

These risks may include, but are not limited to:

  • slips, trips and falls

  • uneven, unstable, steep or slippery surfaces

  • falls from heights

  • rocks, trees, branches and other natural hazards

  • weather conditions including heat, cold, rain, wind and storms

  • dehydration, exhaustion, hypothermia and heat-related illness

  • encounters with wildlife, insects or other animals

  • becoming lost or separated from the group

  • remoteness from medical assistance

  • limited or unavailable mobile phone coverage

  • road and traffic risks

  • risks associated with vehicles, aircraft, boats, ferries or other transport

  • risks associated with accommodation and accommodation facilities

  • risks associated with historic, heritage, abandoned or unfamiliar structures

  • darkness or reduced visibility

  • confined or restricted spaces

  • actions or omissions of other participants or members of the public

  • illness, injury or medical emergencies

  • risks associated with physical exertion

  • risks associated with activities conducted by independent third-party providers

  • delays, disruptions or changes to planned activities

  • other risks inherent in the particular Adventure.

I understand that these risks may result in injury, illness, psychological distress, property damage or, in rare circumstances, serious injury or death.

I voluntarily choose to participate in the Adventure and acknowledge and accept the inherent risks associated with doing so.

4. PERSONAL RESPONSIBILITY AND SAFETY

I agree to take reasonable care of my own safety and the safety of others.

I agree to:

  • follow reasonable safety instructions given by Rob Coad Adventures, its guides, leaders, staff, contractors or activity providers

  • comply with applicable laws, venue requirements and Adventure rules

  • use required safety equipment correctly

  • remain within areas designated for participants

  • advise the organiser if I believe that I am unable to safely continue an activity

  • behave responsibly and respectfully towards other participants, staff, contractors, members of the public and property.

I understand that Rob Coad Adventures may require me to stop participating in an activity where there is a reasonable concern regarding my safety or the safety of others.

5. HEALTH, FITNESS AND MEDICAL CONDITIONS

I acknowledge that different Adventures have different physical and health requirements.

I am responsible for considering whether I am suitably prepared and able to participate in the particular Adventure.

Where requested, I agree to provide relevant information about any medical condition, injury, allergy, medication requirement or other circumstance that may reasonably affect my ability to participate safely.

I remain responsible for managing my own medical conditions and for bringing any medication, medical equipment or other personal items that I reasonably require.

Rob Coad Adventures may request additional information or medical clearance where reasonably necessary to assess whether participation is appropriate.

6. EMERGENCY AND MEDICAL ASSISTANCE

I consent to Rob Coad Adventures, its representatives or appropriate emergency personnel arranging or obtaining reasonable first aid, emergency assistance or medical treatment for me if I am unable to make those arrangements myself.

I understand that Rob Coad Adventures does not provide medical services and that medical treatment may be provided by qualified medical professionals, ambulance services, hospitals or other emergency services.

I acknowledge that I may be responsible for medical, ambulance, evacuation, repatriation or other emergency costs, subject to any applicable insurance coverage and my rights under applicable law.

7. PERSONAL PROPERTY AND EQUIPMENT

I acknowledge that I am responsible for my personal belongings and equipment during the Adventure.

This may include:

  • clothing

  • luggage

  • cameras

  • mobile phones

  • electronic equipment

  • paranormal investigation equipment

  • sporting or hiking equipment

  • personal valuables.

I agree to take reasonable precautions to protect my belongings.

Rob Coad Adventures is not responsible for loss, theft or damage to personal property except to the extent that liability cannot lawfully be excluded.

8. TRANSPORT AND THIRD-PARTY PROVIDERS

Some Adventures may include services or activities provided by independent third parties.

These may include accommodation providers, transport operators, activity providers, guides, tour operators, venues and other service providers.

Rob Coad Adventures may rely on these providers to deliver part of an Adventure.

I agree to comply with the reasonable terms, safety requirements and instructions of those providers while participating in their services or activities.

Nothing in this clause excludes or limits any rights or remedies I may have under applicable Australian law.

9. CHANGES TO THE ADVENTURE

I understand that activities, routes, locations, accommodation, transport arrangements or other components of an Adventure may need to be changed because of circumstances including:

  • safety concerns

  • weather or environmental conditions

  • venue availability

  • transport issues

  • operational requirements

  • decisions of third-party providers

  • government requirements

  • circumstances beyond the reasonable control of Rob Coad Adventures.

Where reasonably practicable, Rob Coad Adventures will seek to provide a suitable alternative.

Any resulting cancellation, refund, credit or other remedy will be dealt with in accordance with the Rob Coad Adventures Terms & Conditions, the specific conditions applying to the Adventure and applicable law.

10. BEHAVIOUR, CONDUCT AND REMOVAL FROM AN ADVENTURE

Rob Coad Adventures is committed to providing a safe, respectful and enjoyable experience for all participants.

I agree to behave in a reasonable, respectful and responsible manner towards other participants, Rob Coad Adventures representatives, guides, contractors, venue staff and members of the public.

Rob Coad Adventures may immediately suspend or terminate my participation in an Adventure where, in the reasonable opinion of Rob Coad Adventures or its authorised representative, my behaviour or conduct:

  • creates or may create a safety risk to myself or another person

  • is threatening, intimidating, aggressive, abusive or violent

  • constitutes bullying, harassment or discrimination

  • repeatedly disrupts the Adventure or materially interferes with the enjoyment or wellbeing of other participants

  • involves damage to property or unlawful conduct

  • involves the misuse of alcohol, drugs or other substances

  • involves refusal to comply with reasonable safety instructions or directions

  • breaches the requirements of a venue, accommodation provider, transport provider or other third-party operator

  • is otherwise reasonably considered incompatible with the safe or orderly operation of the Adventure.

Where reasonably necessary to protect the safety, wellbeing or enjoyment of participants, Rob Coad Adventures may require a participant to leave an Adventure immediately and may do so without providing a prior warning.

If my participation is terminated because of my conduct or breach of these requirements, I acknowledge that:

a. I may be required to leave the Adventure and arrange my own transport and accommodation;

b. I am responsible for all costs associated with leaving the Adventure, including transport, accommodation, meals and any other associated expenses;

c. Rob Coad Adventures is not responsible for arranging or paying for my return travel or alternative accommodation; and

d. to the fullest extent permitted by law, I will not be entitled to a refund or compensation for the unused portion of the Adventure resulting from my removal due to my conduct.

Nothing in this section limits any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

11. ALCOHOL AND DRUGS

I agree not to participate in an activity while impaired by alcohol or drugs where doing so could reasonably create a safety risk.

Rob Coad Adventures may refuse or stop my participation where it reasonably considers that my condition presents a risk to myself or others.

12. PHOTOGRAPHY, VIDEO AND MEDIA

I acknowledge that photographs, video recordings and other media may be captured during Rob Coad Adventures.

I consent to Rob Coad Adventures using photographs, video recordings or my likeness for legitimate promotional, documentary and business purposes, including its website, social media, YouTube channel and advertising.

Where reasonably practicable, Rob Coad Adventures will respect a participant's reasonable written request not to use identifiable promotional footage of them.

I understand that Rob Coad Adventures cannot guarantee that I will not appear incidentally in group photographs, video footage or recordings made during an Adventure.

13. PARANORMAL AND HISTORIC LOCATIONS

Where an Adventure involves paranormal investigation, historic sites, abandoned buildings or other unusual locations, I understand that these environments may involve additional hazards including darkness, uneven flooring, stairs, confined spaces, deteriorated structures and restricted or unfamiliar areas.

I agree not to enter any restricted or unsafe area or touch, move or interfere with property unless expressly authorised.

I understand that descriptions of paranormal activity, historical events, reported phenomena or experiences are provided for entertainment, educational or experiential purposes and do not represent that paranormal phenomena have been scientifically established.

14. INTERNATIONAL TRAVEL

For international Adventures, I acknowledge that I am responsible for ensuring that I have:

  • a valid passport

  • any required visas or travel authorisations

  • appropriate travel insurance where required

  • any required vaccinations or health documentation

  • sufficient personal funds

  • any other documents reasonably required for travel.

I understand that entry into another country is ultimately determined by the relevant government or border authorities.

15. TRAVEL INSURANCE

Where an Adventure requires travel insurance, I agree to obtain and maintain appropriate insurance for the duration of the Adventure.

I understand that insurance policies differ and that it is my responsibility to understand the terms, exclusions, conditions and limits of my policy.

I acknowledge that Rob Coad Adventures does not provide personal travel, medical, cancellation or property insurance for participants unless expressly stated otherwise.

16. RELEASE AND WAIVER TO THE EXTENT PERMITTED BY LAW

To the fullest extent permitted by law, I release and discharge Rob Coad Adventures and its owners, organisers, guides, employees, contractors, volunteers and representatives from claims arising from risks inherent in my voluntary participation in the Adventure.

This release applies to loss, injury, illness, death or property damage to the extent that such loss results from risks that I have knowingly and voluntarily accepted.

Nothing in this document excludes, restricts or modifies any consumer guarantee, statutory right or other liability that cannot lawfully be excluded, restricted or modified.

17. INDEMNITY

To the extent permitted by law, I agree to indemnify Rob Coad Adventures against loss or damage caused by my negligent, unlawful or deliberately wrongful conduct, including damage I cause to property or third parties.

This clause does not require me to indemnify Rob Coad Adventures for liability that cannot lawfully be transferred to me.

18. EMERGENCY CONTACT

I confirm that the emergency contact information provided during registration is accurate and that Rob Coad Adventures may contact that person where reasonably necessary in connection with an emergency involving me during an Adventure.

19. ELECTRONIC ACCEPTANCE

I agree that ticking an acceptance box, signing electronically, submitting an online registration form or otherwise electronically accepting this document constitutes my agreement to its terms.

I acknowledge that my electronic acceptance may be retained by Rob Coad Adventures as a record of my agreement.

20. PARTICIPANTS UNDER 18

Where a participant is under 18 years of age, Rob Coad Adventures may require a parent or legal guardian to provide consent and accept any applicable terms on the participant's behalf.

Rob Coad Adventures may impose additional requirements for participation by minors depending on the particular Adventure.

21. RELATIONSHIP WITH THE TERMS AND CONDITIONS

This document should be read together with the Rob Coad Adventures Terms & Conditions and the specific information provided for the particular Adventure.

If there is any inconsistency, the documents should be interpreted consistently where possible.

Nothing in this document limits any rights or remedies available to a participant under applicable law.

22. ACKNOWLEDGEMENT

By registering for or participating in a Rob Coad Adventures Adventure, I confirm that:

  • I have read and understood this Participant Waiver, Risk Acknowledgement & Consent

  • I understand that participation may involve inherent risks

  • I have had the opportunity to ask questions about the risks associated with my Adventure

  • I have provided information requested by Rob Coad Adventures that is relevant to my safe participation

  • I agree to follow reasonable safety instructions

  • I voluntarily choose to participate in the Adventure

  • I agree to be bound by this document to the extent permitted by law.

By submitting my registration, I confirm that I have read and understood this Participant Waiver, Risk Acknowledgement & Consent and agree to its terms.
